Did you know that if you use and possess another's land without permission you may eventually become the owner.? "Adverse Possession occurs when someone is in open, obvious, continuous and peaceable (meaning the owner never said anything to them) possession of someone else's property, and the original owner does nothing to oust the intruder."*
This possession must occur over a number of years. The statute for true adverse possession is 10 years. If the owner does nothing within 25 years they may have automatically lost possession under Texas Law. To claim title to a property using adverse possession an "Adverse Possession Affidavit" must be filed with the county clerk.
